Reasons

The hearing was conducted by telephone. Representatives of the landlord attended the hearing for the landlord. Several attempts were made to contact the tenant by telephone at the start of the hearing. However, they were unsuccessful. The tenant has not communicated with the Tribunal as to why the tenant would not attend the hearing, and the hearing proceeded in the tenant’s absence.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

The landlord provided rent records in the form of a rent ledger which prove the amount owing at the end of the tenancy and that the tenant was at least 21 days in arrears on the date the application was filed. The tenancy is terminated in accordance with section 55(1)(a) of the Residential Tenancies Act 1986 (RTA).

The landlord has also applied for an Order terminating the tenancy on the grounds that the tenant had abandoned the premises, and the rent is in arrears in accordance with section 61 of the RTA. As the tenancy is terminated in accordance with section 55(1)(a) of the RTA, there was no need for me to determine the application under section 61.

The landlord has applied for the disposal of abandoned goods. During the hearing, the landlord was advised that further evidence would be required to determine the landlord’s application for disposal of abandoned goods.

A landlord does not have to obtain an Order from the Tribunal to dispose of abandoned goods. Sections 62(3)(a) and 62A of the RTA provide that the landlord may deal with goods (other than a tenant’s personal documents) according to the process for disposal of goods after assessment of market value. The process is set out in section 62A of the RTA and summarised in a flow chart on Tenancy Services website.

The landlord said that their preference was to deal with the goods in accordance with sections 62(3)(a) and 62A of the RTA. The claim for disposal of goods was withdrawn.

The landlord has wholly succeeded with the claim. For this reason, I order reimbursement of the filing fee and grant the landlord’s application for suppression of the landlord’s name and identifying details.
