Order
- Samantha Alexander must pay Rentsmart Nz Limited As Agent For I U Holdings $1,533.31 immediately, calculated as shown in table below.
Reasons
- Ms Shannon for the landlord attended today’s hearing. The tenant did not attend the Teams hearing. The tenant was called on the phone number in the application, but the call went to answerphone. I am satisfied that the tenant was given notice of today’s hearing and have proceeded in her absence.
- The landlord has applied for rent arrears, compensation for a missing gate remote, and reimbursement of the filing fee following the end of the tenancy.
How much is owed for rent?
- The tenancy ended on the 18 November 2025 after the tenant gave notice. The landlord provided rent records which prove the amount owing at the end of the tenancy. The landlord has already received the bond and applied it towards the rent arrears, the rent arrears awarded is the amount owing after the bond has been applied to the rent.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The tenant did not return the remote for the electric gate.
- The landlord provided a quote for the emote and the cost of pairing the remote to the gate, that amount is reasonable and is ordered. Filing fee.
- Because Rentsmart Nz Limited As Agent For I U Holdings has succeeded with the claim I have reimbursed the filing fee.
