Reasons

The landlords attended the hearing. Despite an interpreter attending for the tenant, there was no appearance by the tenant and the hearing proceeded in their absence.
The landlords have applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned, and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986 (RTA). A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 13 January 2026 the landlords became aware (or ought to have been aware) that the tenant had abandoned the premises. Rent had not been paid, and so the landlords visited the property. They found the entry door was broken and the property was in a state of disarray with significant damage. The landlords have not had any contact or notification by the tenant of their intention to leave the tenancy.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing of $7,071.42 to 25 February 2026.
The fixed term tenancy was due to end on 14 April 2026. The landlords advised that they had not yet been able to find a replacement tenant.
Where a tenant abandons the premises, they are liable to pay rent until the expiry of the fixed term tenancy or the date of commencement of a new tenancy of the premises. 1
As I cannot know whether or when the landlord will be able to find a new tenant, I have only awarded rent until today’s date. There is nothing preventing the landlord for filing a new claim with the Tribunal for any additional rent once a new tenant is found, or the fixed term period expires.
The landlords also advised that there was significant damage to the property and they may also bring a further claim for the costs associated with this damage. 1 Residential Tenancies Act 1986, section 61(3)(b).
