Reasons

The landlord attended the hearing by video call. Mr Fraser attended the hearing by phone.
Ms Pousima did not attend the hearing. Ms Pousima has been served by email to an email address she provided to the landlord in a phone call on 22 January 2026. The tenant had previously provided a different email address in writing to the landlord; however this email address has not been used for service of these proceedings.
Section 91 B of the Residential Tenancies Act 1986 states that if a notice or other document that is required to be served on a party is not served in accordance with the RTA; and the Tribunal is satisfied that all reasonable efforts have been made to serve the notice or other document on the party in accordance with the RTA, the Tribunal may make directions in relation to substituted service or dispensing with service.
I am satisfied that all reasonable efforts were made to serve the tenant in accordance with the RTA as the landlord provided the last known email address they had for the tenant for service on the tenant. The Tribunal file indicates a Tribunal mediator has been in contact with Ms Pousima therefore I consider she has notice of the claim. In the circumstances I treated service to the current known email address to the tenant as substituted service and proceeded to hear the matter. 1
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. 2
The landlord provided rent records which prove the amount owing as at 4 May 2026. The bond is to be paid to the landlord immediately to offset the rent arrears.
Because the landlord has wholly succeeded with the claim, I must reimburse the filing fee.
The landlord did not seek name suppression. Mr Fraser initially asked for name suppression then withdrew the application. No suppression orders apply in this matter.
