The tenancy of Darren Hirini Ramon Whaanga at 1025A Bledisloe Street, Raureka, Hastings 4120 is terminated, and immediate possession is granted to [The landlord/s].

This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to him and so the hearing proceeded in his absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears, reimbursement of the filing fee and payment of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 5 January 2026 the landlord became aware that the tenant had abandoned the premises. He was advised of this during a telephone conversation with the tenant’s aunt.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

This was a fixed term tenancy due to expire on 26 March 2026.
The tenant is therefore liable to pay rent until the expiry of the fixed term or to the date a new tenancy begins at the premises, whichever is the earlier.
I do not know when or whether a new tenancy will start and so I am ordering the tenant to pay rent to today’s date. A further application may be made for rent at a later date.
The landlord provided rent records which prove the amount owing as at today’s date. The last payment of rent was made on 4 December 2025.
