The landlord has applied for termination of the tenancy on grounds that the tenant had threatened to assault its staff and/or agent of the landlord.

Should the tenancy be terminated?

The Tribunal must terminate a tenancy where the tenant has assaulted, or has threatened to assault, the landlord or agent of the landlord. See section 55(1)(c) Residential Tenancies Act 1986.

The landlord is a social housing agency.

On 18 January 2026, the tenant threatened to assault the landlord’s security guard patrolling the Phillipstown Courts.

The tenant was throwing several punches that were connecting with the front driver’s side window of the security guard’s vehicle while the guard was inside the vehicle, being fearful of the tenant.

I accept the statements of the guard that if the window had been open, these punches would have connected with the guard.

These punches were being thrown with force, and it was surprising that the window did not break. The tenant also tried to open the security guard’s driver’s side door and it was apparent to the guard that he was trying to open the door to assault him. The tenant was yelling at the guard to “go away, to fxxk off or words to that effect”.

When the guard tried to de-escalate by driving away, the tenant started kicking the rear bumper of the car, causing damage.

Being satisfied that a threat to assault an agent and/or staff of the landlord had been made by the tenant, the Tribunal must terminate the tenancy. Section 55(1)(c) RTA places a threat of assault on the same level and degree of seriousness with actual assault.

In this case, the threat to assault was forceful and could have succeeded if the window of the guard’s vehicle did break from the tenant’s aggression exhibit on that day.

I therefore terminate the tenancy as requested by the social housing landlord.

Because Ōtautahi Community Housing Trust has wholly succeeded with the claim I must reimburse the filing fee.
