The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.

What date did the tenancy end?

The fixed term tenancy expired on 23 November 2025 and the tenants then gave 21 days’ notice to terminate the tenancy. The tenants said they actually moved out on 12 December 2025. However, the tenants sent their termination notice of 23 November 2025 to the incorrect email address, which had been used for maintenance logs and which was not monitored by a person, and so the landlord did not find out about the tenants’ termination notice, or any of their follow up emails, until they reached out to the tenants about rent arrears on 6 January 2026 and were informed by the tenants then of the termination notice. The tenants then forwarded their emails to the landlord on 6 January 2026. As such, the landlord said that, as they had not received the tenants’ termination notice until 6 January 2026, as the tenants had not sent the termination notice to the correct email or address for service, the notice period then began to run from 6 January 2026.

The date for the end of the tenancy and what occurred was discussed at the hearing. The tenants realised they had sent the termination notice to the incorrect email in error.

Given this evidence, which was provided by way of copies of emails between the parties, I find the landlord first received the tenants’ termination notice on 6 January 2026 and as such, the end date of the tenancy would be 21 days later, which would be 27 January 2026.

The landlord provided an updated rent summary during the hearing, which was discussed. The rent summary provided showed the rent arrears owing by the tenant to the landlord up to 27 January 2026 is $6,985.71. Refund of the bond

The tenants were willing for the bond to be applied against any rent arrears owing by them. The Bond Centre is to pay the bond of $4,800.00 ([Bond number suppressed]) to [The landlord/s] immediately. Filing fee

Because [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee. Suppression

Both parties requested name suppression. The landlord is entitled to name suppression because they have been successful with the claim. The tenants attempted to give proper notice to terminate the tenancy but sent it to an incorrect email address, which is unfortunate, and has resulted in them owing more rent arrears than would otherwise have been the case. In the circumstances, and given the evidence, I find the tenants’ interests outweigh the public interest in publishing their names. Therefore, I order that the parties’ names and identifying details and the tenancy address are not to be published. See sections 95A(1) and 95A(4) Residential Tenancies Act 1986.
