How much is owed for rent?
- On 1 December 2025 a friend of the tenant’s notified the landlord that the tenant was incarcerated. Subsequent to that, on 17 December 2025 the tenant signed a notice to end his tenancy.
- Tenants are required to give 21 days’ notice of termination. However, the landlord elected to put an end date just 2 days after the note tenant’s notice – that is, on 19 December 2025.
- I accept the evidence that on 19 December 2025 the tenant owed $1,018.29 in rent arrears.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The photographs show that at the end of the tenancy rubbish was left both inside and outside the house.
- The landlord withdrew that part of their claim that related to the cost of removing rubbish from outside the house because the rubbish was put in the Council bins and collected kerbside.
- I accept that the tenant ought to pay the cost of removing rubbish left inside the house. This was invoiced as being $164.21. C ter Haar 06 May 2026
