Reasons
- Both parties attended the hearing which was convened by way of rehearing granted by Tribunal Order as the Tribunal determined there may have been a miscarriage of justice.
- The landlord’s claim is therefore heard afresh.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was in arrears on the date the application was filed. Despite serving notices to repay the arrears, and a 90 day notice to end the tenancy, the rent remains more than 6 weeks in arrears and the tenant remains at the property. The tenancy must be terminated both because of the significant rent arrears and because a valid 90 day notice has been issued. See sections 55(1)(a) 56, 60 and 77 of the Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- Before making the rent arrears order the Tribunal has recalculated/reconciled all rent payments from the commencement of the tenancy, including all rent paid to the owner prior to the applicant taking over management of the property in November 2025.
- The rent arrears amount ordered is confirmed as accurate and includes the partial refund of the bond to the landlord made by the bond centre in accordance with the Tribunal order of 3 March 2026.
- The Tribunal declines to award the costs associated with enforcing the prior possession order both because there was an operative stay of proceedings in place at the time the landlord applied for the warrant and because the landlord’s claim was not amended to include that claim until this morning and the tenant was not therefore properly served with notice that claim was to be made until after the hearing had begun.
- Because Rent My Home Limited has wholly succeeded with the claim I must reimburse the filing fee.
