[The tenant/s] must pay rent and the debt as follows: a. By making weekly payments of $190.00, being $165.00 for rent and $25.00 for the debt. b. Payments will be every Wednesday , with the first payment on 4 March 2026 and continuing until the debt is repaid. Then weekly rent will be paid at the standard $165.00 per week.

If the tenant fails to comply with 5 above, then the landlord may terminate the tenancy within 2 working days and will take immediate possession of the premises due to the ongoing breach of the tenant failing to keep the property in a reasonable standard.

Reasons

Both parties attended the hearing by the remote registry.

The landlord has applied for a conditional termination of the tenancy, for rent arrears and failing to mow the lawns and remove the rubbish that is outside on the lawn. The tenant wants to repay the debt to avoid immediate termination and clean up the lawns.

The tenant breached their obligations by failing to mow the lawns and remove the rubbish. The landlord served a 14-day notice on the tenant, but the breach was not remedied within the required period. Although the tenant advised that the rubbish has now been removed.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I am also satisfied that the tenant will attend to the lawns and that the rubbish issue has been resolved. I have granted a conditional termination order.

Both parties consent to the orders being made as outlined.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.

I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further breach. I have granted a conditional termination. See section 78(3) Residential Tenancies Act 1986.
