Only the landlord appeared at the hearing. I am satisfied that the tenant has been properly notified of the hearing, and therefore I will proceed to consider the claim in his absence.

BACKGROUND

The tenancy commenced on 5 December 2025. The sole tenant is Karl Bartley.

The file indicates a range of issues arising during the tenancy.

Ultimately the tenancy has come to an end.

When the premises were returned to the landlord, the landlord has described wide- ranging damage, which includes: a. Significant damage to the oven. b. Broken door handles. c. Hole in plasterboard wall. d. Cigarette burns to the carpet in three rooms. e. Damage to the fibre (internet) infrastructure. f. Removal of smoke alarm. g. Damaged curtains and nets.

The landlord filed this application with the Tribunal, seeking orders in relation to the rent arrears, damage, exemplary damages and bond.

The landlord also lodged a claim with the insurer, and that claim was accepted, however there was a $1,000 excess that applied.

ANALYSIS

At the hearing today, the landlord advised that given the insurer has accepted the claim, she is only seeking an order in relation to the rent arrears and insurance excess. Claim 1 – Rent arrears

The landlord seeks an order for rent arrears, on the basis that the tenant did not give notice. The landlord seeks an order for three weeks of rent in lieu of the notice, to the sum of $1,650.00.

The Residential Tenancies Act 1986 (RTA) requires that a tenant in a periodic tenancy, give 21 days notice to end the tenancy, which necessarily means the tenant is liable to pay the rent for those 21 days.

I am satisfied that, taking into account the 21-day notice period, the tenant was in arrears with rent of three weeks. I therefore order the tenant to pay the landlord $1,650.00 for rent arrears. Claim 2 - Damage

The landlord seeks to recover the insurance excess of $1,000. Obviously that is in the tenant’s interest as it has limited the orders that could have been made.

That means that the landlord needs to establish $1,000.00 of damage to the property, and that can be established in relation to the claim for the oven alone.

The landlord seeks compensation for the oven which was destroyed during the tenancy. The evidence is that the oven door has been ripped off and later found outside the tenancy. The damage was such that the oven could not be repaired. The oven was near new at the start of the tenancy, and has cost the landlord $1,180.00 to replace.

Where damage is caused during a tenancy, and is beyond fair wear and tear, the tenant must prove it was not careless or intentional damage. In this case the oven has plainly been intentionally damaged.

Tenants are liable for the full cost to remedy intentional damage.

I accept that the cost to replace the oven was over $1,000.00, so this claim is established and ordered in full. Claim 3 - Bond

The bond is to be released to the landlord in full.
