Reasons
- The landlord attended the hearing by telephone.
- The tenant did not attend the hearing.
- The landlord made application to the Tribunal on 26 January 2026 which was more than two months after the end of the tenancy. This means that the application and other documents required to be served on the tenant must be: a. Served on the tenant personally; or b. Posted to an address that the tenant has given to the landlord in writing within the last two months; or c. Delivered to the tenant's place of residence; or d. Given to an authorised agent of the tenant; or e. If the landlord files the application no later than 2 years after the termination of the tenancy, transmitted to an email address given by the tenant as an address for service. See section 91A(2) Residential Tenancies Act 1986 (“RTA”).
- The landlord’s application and supporting documentation and the Notice of Hearing were emailed to the email address for service provided by the tenant in the tenancy agreement. The Tribunal is satisfied that the tenant has been served.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
- The tenancy ended on 14 September 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy.
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord gave evidence that the tenant kept a dog at the premises and that the carpets required commercial cleaning to remove the smell and staining.
- On the evidence submitted to the Tribunal and provided at the hearing, the landlord’s claim is proven.
- Because Holmwood Property Management Sherborne Limited As Agents For Manprit Kaur Dhatt And Baljit Singh has wholly succeeded with the claim I must reimburse the filing fee.
