[The tenant/s] must pay rent and the debt as follows: a. By making fortnightly payments of $760.00, being $724.00 for rent and $36.00 for the debt. b. Payments will be every fortnight with the first payment on Wednesday 6 May 2026 and continuing until the whole of the debt is cleared.

Payments will be allocated in the following order: rent and then rent arrears.

If the tenant fails to pay rent and rent arrears within 5 working days of the due dates: a. The tenancy at 7 Gosport Place, Onehunga, Auckland 1061 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Reasons

Both parties attended the hearing the landlord by video conference and the tenant by phone.

The landlord has applied for termination of the tenancy, rent arrears and payment of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.

After a discussion with both parties at today’s hearing I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have therefore granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Suppression of tenant’s name

Section 95A of the Residential Tenancies Act 1986 provides that: (1) The Tribunal may, on the application of any party to the proceedings or on its own initiative, having regard to the interests of the parties and to the public interest order that all or part of the evidence given or the name or any identifying particulars of any witness or party not be published. (2) An order may be subject to any conditions that the Tribunal considers appropriate. (3) If a party that has wholly or substantially succeeded in the proceedings applies for an order that their name or identifying particulars not be published, the Tribunal must make the order unless the Tribunal considers that publication is in the public interest, or is justified because of the party’s conduct or any other circumstances of the case.

I am allowing the tenant’s application for suppression of their name pursuant to s95A(1).

I do so because I accept that these arrears have been caused by very personal circumstances and the tenant has done her best to catch up on the arrears as quickly as she can. I note too that the landlord has advised that this tenant is a very good tenant and one of very long standing. Taking this into account I am satisfied that any public interest in publishing this tenant’s name is outweighed by the fact that by and large this tenant is reliable communicative.
