The tenancy commenced on 10 October 2025 in the names of [former tenant] and [tenant].

On 19 December 2025 [former tenant] was removed from the fixed term tenancy agreement.

The Tribunal heard that at the end of [former tenant]’s tenancy he owed $1,050.00 in rent arrears. The bond was to have been refunded to the landlord to recover the outstanding amount but was locked following this application. Should the tenancy be terminated

Under section 55(1) of the Act, the Tribunal must, subject to subsection 55(2) terminate the tenancy, if at the time the application was filed, the rent was at least 21 days in arrears.

The landlord seeks to enforce the termination with immediate effect.

Section 138 of the District Court Act 2016 holds that normally an order cannot be enforced until 48 hours have expired unless a “Judge grants leave”. However, section 106(2) of the Residential Tenancies Act 1986, which relates to enforcement of possession orders, confirms that reference to a “Judge” in section 138(1) applies as if it were reference to a Tenancy Adjudicator.

This is a case where it is appropriate that leave be granted for an immediate enforcement of the possession order. There is a genuine risk the former partner of the tenant, who was most recently at the property on 4 April 2026, may again return to the property and cause further damage to the premises, violence, and disruption to the neighbours.

The landlord provided up to date rent records which prove the amount owing at the date of hearing totalled $4,278.46. The tenant did not dispute the amount claimed and that is what is ordered. Other matters
