The landlord attended the hearing by telephone today. The tenant did not attend, and his phone went to voicemail when I called. I continued with the hearing in his absence because he has been sent email notice of the hearing date and time to his address for service and been sent email and text reminders.

The landlord has applied for an order authorising the disposal of goods that the tenant left at the premises at the end of the tenancy.

The tenant did not attend a first hearing of this matter. After that hearing, I made an order setting out the orders I proposed to make.

I am satisfied the tenant has had fair opportunity to attend the hearing today and has not done so. Disposal of all goods left at the premises by the tenant

The parties agreed during previous proceedings that the tenant’s goods would be transported to his new address by a moving company. The cost of this was to be met by:- a. Refund of the bond of $960.00 to the tenant which the tenant could then use to pay the moving company. The bond was refunded to the tenant by order dated 5 November 2025 in previous proceedings between the parties. b. Payment of $1,405.00 by the landlord which would then be taken into account in any compensation awarded to the tenant in the previous proceedings. The landlord paid this amount to the moving company.

The tenant did not pay the $960.00 to the moving company and did not make alternative arrangements to collect his goods within a reasonable time.

It is not practicable for the landlord to return the goods to the tenant in any other way.

The landlord has provided evidence that [The party] of the goods have a value above the cost of storing, transporting and selling them. The landlord has provided evidence that a surfboard and a wetsuit left by the tenant at the premises have a market value of $360.00.

The landlord has supplied a quote of $500.00 for a skip bin to be delivered and collected to enable him to dispose of the tenant’s goods.

I have made orders that:- a. The landlord may dispose of the tenant’s goods in any way that he sees fit; and b. The tenant must pay the landlord the difference between the cost of the skip bin and the value of the surfboard and wetsuit which is $140.00.
