Reasons

This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link provided to her and nor did she ring in to the hearing as directed in the Notice of Hearing sent to her. The hearing proceeded in her absence.
The landlord has applied for termination of the tenancy, payment of outstanding water rates and reimbursement of the filing fee.

Should a conditional termination order be made?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days, and establish that the tenant has failed to do so. See section 56(1) Residential Tenancies Act 1986.
The tenant breached their obligations by failing to pay the water rates. On 13 January 2026 the landlord served a 14-day notice on the tenant but the breach was never remedied and water rates continue to accrue.
As discussed at today’s hearing, it was agreed that at this stage it would be inequitable to terminate the tenancy because the amount owing is relatively small.
However, the tenant should be alert to the possibility that if she continues not to pay the water rates the outcome of a further application may well be different.

How much does the tenant owe?

I accept the evidence showing that the tenant has not paid any water rates since she started the tenancy on 10 June 2025. The amount owing as at 18 April 2026 is $479.37.
I am also ordering the tenant to reimburse the filing fee to the landlord because the landlord was substantially successful with this claim against her. C ter Haar 05 May 2026
