Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The tenant did leave most of the premises reasonably clean and tidy. I have assessed that the $60.00 of the $121.90 the landlord paid for cleaning is reasonable compensation based on what work needed to be carried out to make the property reasonably clean, as opposed to perfectly clean.

The grounds needed some work. I am satisfied that the tenant should pay $100.00 of the $149.00 claimed.

The amounts ordered are proved.

Is the tenant responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA. The blind cords

I am satisfied that the blinds were damaged during the tenancy by the cords being significantly tangled. There was some minor tangling of the cords at the start of the tenancy and therefore I have ordered $150.00 of the $178.70 claimed. Wall repair

The landlord has claimed for wall repairs. There was existing damage that the landlord had not repaired prior to the tenancy. The tenant added plaster to the hole and peeling paint. The landlord is claiming $330.00 to repair and paint the wall however has not carried out the work.

From the evidence I cannot determine that the tenant has seriously affected the condition of the wall. This is consistent with the landlord not carrying out repairs before the next tenancy. In any claim it must be proved that the party has suffered a loss. It has not been proved, on balance of probability, that the landlord has suffered a loss regarding the wall. The claim is dismissed. 5437966 3 End of tenancy cost

The tenancy was scheduled to end in October 2026. The tenant asked for her fixed term to be reduced to January 2026. The landlord agreed to the request to end the tenancy and may claim the cost of assigning the tenancy or commencing a new tenancy.

The tenant believes the amount claimed for establishing a new tenancy is excessive. I am satisfied that costs claimed are reasonable. Bond

The tenant stated that she has received the full bond less $120.00. The order is made for the remaining $120.00 to be paid to the landlord. Filing fee

Because the landlord has been successful with the claim the filing fee of $28.00 is ordered to be paid by the tenant.
