Manu Fangupo owes [The landlord/s] $3,730.51 (“the debt”).
Manu Fangupo must pay rent and the debt as follows: a. By 10 fortnightly payments of $2,000.00, being $1,660.00 for rent and $340.00 for the debt. b. A final payment of $1,990.51, being $1,660.00 for rent and $330.51 for the debt. c. Payments will be every other Friday, with the first payment on 24/04/2026 and continuing until 11/09/2026.
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenant fails to pay rent and rent arrears within 1 working day of the due dates: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 1 working day of the due date, the filing fee will be payable immediately.

Reasons

Both parties attended the hearing held remotely today.
Rent was at least 21 days in arrears on the date the application was filed.
The law says the Tribunal must make either an immediate termination order or an order allowing repayment of the arrears by a certain date but with termination if they are not paid on time (a “conditional termination” order); see section 55(1)(a) and (1A) Residential Tenancies Act 1986 (RTA). Payments must be made on time or the tenancy will terminate immediately
The landlord wants immediate termination of the tenancy.
After hearing from both parties, I have decided to allow the tenant one last chance to repay the debt and keep rent payments up to date. This is because the rent was paid on time for more than a year and the problems happened only in January this year when the tenant said she and her husband had no income.
I also make this order because the tenants have proposed a reasonable repayment amount. They agree to pay $2,000.00 per fortnight starting next Friday 24 April 2026. This is $1,660.00 for fortnightly rent and $340.00 towards the debt.
If any fortnightly payment is more than one working day late, the landlord can immediately terminate the tenancy.
I am satisfied the tenant will pay the debt and is unlikely to miss any more rent.
The conditional termination order will finish if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
The landlord has been successful with the claims so I award the filing fee and suppress its name.
