Both parties attended the hearing.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and payment of the Tribunal application fee.
The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date: section 61 Residential Tenancies Act 1986 (the Act).
Mr Turnbridge had a tenancy of the premises commencing on 31 May 2025. Rent was agreed at $180 per week. No bond was paid. The tenancy consisted of a bedroom with shared use of the facilities with four other tenants of the landlord.
Mr Turnbridge said that he vacated the premises on 3 January 2026. He said that he told the landlord on 20 December 2025 when he came to mow the lawns that he would be moving out in two weeks. The landlord denies this and said that he was not in New Zealand on 20 December. In any event, notice to end a tenancy must be in writing.
The landlord said that he first became aware that Mr Turnbridge had vacated the premises on 28 January. Generally, a landlord is entitled to rent for 21 days after first becoming aware that a tenant had abandoned the tenancy. However, the landlord took back possession of the premises on 5 February 2026. He is therefore entitled to rent to that date.
The amount of rent owing to 5 February 2026 has been established by the production of a rent record. Mr Turnbridge did not dispute the amount claimed to that date.
The landlord has been successful in his claim and is therefore entitled to payment of the Tribunal application fee.
The landlord applied, in his application, for a suppression order. As the landlord has been fully successful in his claims, he is entitled to an order pursuant to section 95A of the Act. I therefore order that his name and identifying details be suppressed.
