- On 5 February 2026, the landlord filed an application seeking termination of the tenancy, rent arrears, outstanding water rates, refund of the bond and reimbursement of the filing fee.
- The hearing proceeded by way of video conference. Ms Eve Pallatt, Property Manager, appeared for the landlord. The tenants failed to appear. The Tribunal was satisfied the tenants were properly served with the notice of hearing and the case proceeded in their absence.
- At the hearing the landlord withdrew their claims for termination of the tenancy, and outstanding water rates. The Tribunal heard the on 20 April 2025 the tenants had made a payment of $3,920.00 towards their rent arrears and, this morning, cleared the outstanding water rates.
How much is owed in rent arrears?
- The landlord provided an up-to-date rent record which proved the amount owing to the date of hearing totals $570.00. The amount claimed is ordered.
- The Tribunal takes the nonpayment of rent seriously and declares that the tenant is required to pay rent as and when it falls due in accordance with the tenancy agreement and section 40(1)(a) of the Residential Tenancies Act 1986. Failure to do so could result in a breach notice being issued and further application to the Tribunal. Other matters
