Reasons

Both parties attended the hearing by video. Cameron Banks attended for the tenants. He joined a few minutes after the hearing started and was not visible on the video call.

This application was made on 9 February 2026 and the parties were advised of the hearing date on 26 February 2026.

The Landlord and Tenants are parties to a residential tenancies agreement which started in August 2022. The tenancy is for a fixed term to August 2026. The Landlord provided a copy of the tenancy agreement with its application. Termination & Rent

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Rent was at least 21 days in arrears on the date the application was filed. I must terminate the tenancy. See section 55(1)(a) Residential Tenancies Act 1986. 1

There are two dwellings on the premises. The tenancy agreement provided for the tenants to sublet the dwellings. They sublet both.

The tenants stopped paying rent in December 2025. The last payment was for partial rent on 29 December 2025.

At the hearing, Mr Banks said that the agreement should have been “voided” when the landlord entered into a direct agreement with a tenant for the minor dwelling (174A) on the premises. He said that he was paying for the entire property, and that the landlord went behind his back to try to get payment directly from his tenants.

The landlord said that she did not contact any tenants until after Mr Banks had stopped paying rent. She also said that Mr Banks gave permission for her to rent the minor dwelling to reduce the amount of his debt. Mr Banks then conceded that he had given permission for the landlord to advertise the premises for rent, but disagreed with the amount the landlord was seeking.

Rent had not been paid for two months when the landlord entered an arrangement to rent the minor dwelling to a third party 2 . The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount owing under this tenancy agreement is $45,600. The landlord has received rent of $5,850 directly from the tenant of the minor dwelling. The amount owing by these tenants, for rent, to 26 April 2026 is $39,750. Damage

The landlord claimed the cost of having a plumber clear a toilet and drains blocked with baby wipes and inappropriate items being flushed. The landlord provided evidence by way of a plumbers invoice and photographs. The claim is proved. Other Orders
