Reasons
- The landlord attended the hearing held remotely today. I telephoned the tenant however the phone went to voicemail. I continued with the hearing as the tenant has been emailed notice of the hearing date and time to the address for service and sent text reminders.
- The landlord has applied for compensation for an insurance excess and cleaning costs following the end of the tenancy.
- Tenants must leave premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. Section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986 (RTA).
- The tenants did leave some parts of the premises reasonably clean (bench surfaces, shelves, outdoor areas) but more cleaning was needed of floors, shower and toilet, door and wall surfaces.
- The cleaning invoice is for $945.00. I reduce this to $550.00 to recognise that the tenants did leave some areas reasonably clean and that the invoice includes work to clean the premises to a higher standard than required from a tenant.
- The more significant issue is that the hot water cylinder and connected copper piping was missing at the end of the tenancy.
- I was supplied with photos showing the original cylinder, the empty hot water cupboard (the day after the tenancy ended), and the new cylinder.
- Evidence included documents proving that a police report was made, an invoice for the cost of replacement, and that there has been an insurance settlement with the landlord for the invoiced cost less an excess of $1,500.00. This excess includes an additional amount of $500.00 for deliberate damage.
- I accept it is proven that this chattel was missing at the end of the tenancy and that the landlord has suffered loss of $1,500.00. I award this amount.
- The landlord’s claim is successful, so I award the filing fee.
- The bond has already been refunded to the landlord by consent.
- I make a money order for the amount owing which is $2,078.00.
- No suppression orders were sought.
