- The landlord’s representative attended the hearing I held today by video. The tenants did not attend.
- The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date 1 . A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- On 5 February 2026 the landlord became aware that the tenants had abandoned the premises. An inspection showed that the premises were mostly empty. The landlord has not been able to contact the tenants since then. The Police gave the landlord information that confirms the abandonment of the tenancy.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
How much does the tenant owe?
- The landlord provided rent records which prove the amount of rent owing when the tenancy was found abandoned. I have awarded 21 days’ rent in lieu of notice from that date.
- I have reimbursed the landlord the filing fee on the successful application. The bond
