In October 2025 the tenant advised that he wanted to end the fixed term tenancy early, and the landlords arranged for him to sign a break lease form. The form confirmed that the tenant would be liable for a break lease fee of $575.00 and rent until a new tenancy was in place (or the end of the fixed term, whichever occurred first).
A new tenancy commenced on 9 January 2026, and the landlord therefore seeks rent of $4,400.00 to 8 January 2026 together with the break lease fee.
The amounts sought are reasonable and in accordance with section 44A of the Residential Tenancies Act 1986 (RTA) and are therefore awarded.
