- Elliot James Shaw owes 719 Remuera Road Limited $21,885.14 (“the debt”) as calculated in the table below.
- Elliot James Shaw must pay rent and the debt as follows: a. By making an immediate payment of $2,528.00 ($2,500.00 for rent and rent arrears and $28.00 for the filing fee). b. A final payment of $19,357.14 by 4pm on Tuesday 26 May 2026.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at Unit 2, 719 Remuera Road, Remuera, Auckland 1050 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing which was held remotely
- The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and payment of the bond.
- There are two ways of resolving situations such as this. Either the tenancy is terminated because the rent is more than 21 days in arrears. Or the parties may come to an agreement (a conditional termination order) in which they agree as to how the rent and outstanding debt can be paid off.
- The tenant wants to repay the debt to avoid immediate termination and the landlord has agreed to a payment plan.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- After discussion with the tenant today, I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. This is because I accept his evidence that he is going to be receiving a payout from a former business partner. I also note that during the hearing the tenant paid the amount agreed to and reflected in Order 2(a) above.
- For these reasons I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. C ter Haar 19 May 2026
