The landlord attended the hearing held on 24 June 2026 by video. The tenant did not attend the hearing. An attempt was made to join the tenant to the 5443828 2 hearing by telephone, but one number went to voicemail and there was no response to the other number.
The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy.
The bond was released to the landlord in March 2026 so that amount has been deducted from the award against the tenant.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenant did not remove all rubbish, and the lawns needed mowing.
The tenant did not return the keys.

Is the tenant responsible for the damage to the premises?

The landlord claimed for damage to the carpet caused by a dog kept at the premises. While the tenant told the landlord that the dog was there temporarily the evidence is that there was a strong dog smell at the premises when the tenant vacated.
The landlord attempted to clean the carpet, but this did not remove the dog smell from the carpet. The invoice from the carpet cleaner states, “carpet clean for strong dog smell”. The cost for carpet cleaning is awarded.
As cleaning of the carpet did not remove the smell the landlord has replaced the carpet. The landlord advised that the carpet was new at the beginning of the tenancy. Carpet has a normal life expectancy of 10 years, and this was a five- year tenancy. That means that the carpet has five years of useful life yet. I have depreciated the carpet by 50% because the tenant is liable for the depreciated value of the carpet, not the full replacement cost. The compensation should reflect the remaining value of the damaged item, and the landlord should not be put in a better position than if the damage had not occurred.
Because Oxygen.Co.Nz Limited As Agent For Kiyani Investments Limited has wholly succeeded with the claim I must reimburse the filing fee. 5443828 3
