The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
This tenancy lasted less than six months. For the tenant’s pets to have caused this damage, the Tribunal is persuaded that it was caused by the tenant allowing the soiling to continue, knowing that damage would occur. The damage was therefore intentional damage.
The amounts ordered are proved.
The Tribunal must consider betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached their obligations, and should not be better or worse off. The landlord could not provide evidence of the age of the carpet. The photographic evidence confirms that it was in reasonable repair at the start of the tenancy.
It is reasonable for the Tribunal to determine that the carpet would have been in serviceable condition at the end of the tenancy but for the actions of the tenant. It had a residual utility value. It is therefore appropriate for the Tribunal to award a sum that reflects that residual value.
