How much is owed for rent?

The tenants gave notice but were not able to fully move out of the house on 5 January 2026. I have looked at the emails between the tenants and the property manager and I have seen photos taken at the time which show the large amount of rubbish in the garage. I can see the tenants arranged for a skip bin to be delivered on 13 January. The tenants were also completing repairs inside the house after 5 January. Taking all this into consideration I find the tenancy ended on 13 January 2026. The landlord provided rent records which prove the amount owing at the end of the tenancy.

Did the tenants comply with their obligations at the end of the tenancy?

Tenants must return the premises in a reasonably clean and tidy state and remove their rubbish at the end of the tenancy. See section 40(1)(c) and (e)(iii) Residential Tenancies Act (RTA).

The tenants agreed to the claims for cleaning and lawn mowing.

The amounts ordered have been proved.

Are the tenants responsible for the damage to the premises?

There are claims for repairs to the walls. The landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenants must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

The tenants agreed they caused about five holes in the walls during the tenancy. These were plastered but not painted at the end of the tenancy. I have seen photos showing the damage. The damage is more than fair wear and tear and the tenants have not disproved liability for the damage. The claim looks reasonable to me, except for the charge for painting three walls in the lounge.

The tenants did not agree there was any need to paint three walls in the lounge, because there was only damage on two walls. This is the landlord’s claim to prove. It is not clear from the photos that there was damage on three walls and so I have allowed a lower amount for painting. Other orders

Because the landlord has substantially succeeded with the claim I have reimbursed the filing fee.

A request has been sent to the Bond Centre.
