The photographs taken at the end of the tenancy show the tenant did not remove all rubbish. The yellow and glass Council bins had rubbish in them. Inside the premises, a shoe box, toilet roll, sunscreen bottle, sponge and other small, miscellaneous household items were left behind.

The tenant put the red Council bin out for collection, which was due to be collected on Monday, 16 February 2026. The yellow and glass Council bins were not due for collection until the following week. In these circumstances, the tenant should have disposed, or organised for the disposal, of the rubbish at the recycling centre or tip at the end of the tenancy.

The landlord submitted an invoice for $100.00 to remove the rubbish contained in the yellow and glass Council bins.

The items left inside the premises were minor and small. I consider $10.00 compensation to be reasonable to reflect the likely cost to dispose of these minor items.

For these reasons, the landlord’s claim for rubbish removal is granted for $110.00.

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. 2 1 Residential Tenancies Act 1986, section 40(1)(e)(iii). 2 Residential Tenancies Act 1986, section 40(1)(e)(ii) – (v).

“Reasonably” clean means clean to the standard an average, reasonable bystander would consider reasonable. 3 It does not mean commercially clean, 4 spotless 5 or to a hotel or motel standard. 6 The better the premises and the higher the rent payable, the higher the standard expected. 7

The photographs taken at the end of the tenancy prove the tenant left the premises reasonably clean and tidy. The floors have been vacuumed and mopped. Bench surfaces have been wiped down. The kitchen and bathroom have been cleaned. Overall, the premises look very reasonably clean and tidy.

The landlord claims the skirting boards and power points were dusty. They also claim there were some smudge marks on the kitchen cabinetry and the extractor fan in the kitchen was not cleaned. A tenant is not required to leave the premises in an immaculate condition. These minor issues do not render the overall state of the premises to be unreasonably clean and tidy. Landlords often like to ensure that premises are presented in a pristine condition for new tenants, because this ensures the new tenancy starts off on a good footing. This is understandable, however, it is not the responsibility of the outgoing tenant to provide the premises in such a condition. This is a cost of business that landlords must bear themselves.

For these reasons, the landlord’s claim for $180.00 for cleaning is dismissed. Filing fee & name suppression

Both parties have been substantially successful with their applications. Therefore, I do not order either party to reimburse the filing fee. For the same reason, I grant both parties’ request for name suppression.
