It is the landlord’s responsibility to have all evidence available during the hearing. I gave the landlord a further 30 minutes to email the entry and exit reports to the Tribunal. Despite this, they were still not received by the due time.

The Tribunal has extended itself in making contact with the landlord to join the hearing, waiting fifteen minutes until the landlord joined the hearing and allowing a further period after the hearing within which to submit evidence. No further evidence was received by the allowed time.

On the evidence before the Tribunal, it is not satisfied on the balance of probabilities that the landlord has suffered the losses for which it is claiming compensation. The Tribunal cannot be satisfied that: a. The photographic evidence reflects the state of the property at the end of the tenancy. b. The damage was not present at the start of the tenancy. c. The claimed damage was not fair wear and tear. d. The submitted invoice relates to work done at the time the tenancy ended.

For these reasons, the landlord’s claims are dismissed.
