In Nixon v Geal-Otter DC North Shore, 30 January 1996, [1996] RTHNZ 2, 1996 WL 35049225, Judge Thorburn stated: Adjudicators and the Court must be careful to recognise that in any tenancy there will be a deterioration of condition because of fair wear and tear. It can be no other way. Mere use of premises will by the law of inevitability produce a deterioration of condition.
This was a very long tenancy. The statement of work of the landlord reflected a significant renovation of the premises that were not sought. What the landlord di seek was recovery of the costs of repairing three holes in walls. The tenant explained she had attempted a series of plastering repairs throughout but she acknowledged this had not been completed. The exit photos confirm this.
The costs of $130.09 were sought and I consider the evidence supports both the need and costs. This is awarded.
The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
The amounts ordered are proved. Time payment
The tenant proposed a time payment scheme that was accepted by the landlord. The terms are the same as those in this order.
