On 26 February 2026, the landlord applied for termination of the tenancy for rent arrears of at least 21 days at the date of filing the application and rent arrears.

The landlord has provided an up dated rent summary. This confirms that at the date of filing the tenant was at least 21 days in arrears. However, subsequent to the filing of the application the tenant has made payments which significantly reduce the arrears.

The landlord no longer seeks immediate termination and submits that a conditional order may be more appropriate. The tenant wants to repay the debt to avoid immediate termination. Law

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986 (Act).

A conditional termination order gives the tenant a final chance to remedy the rent arrears and keep their tenancy, but if they fail to comply, the tenancy will be terminated without further need for a hearing. Before the Tribunal makes a conditional termination order it must be satisfied, on the balance of probabilities, that the tenant will pay the rent arrears within the specified period, and it is unlikely the tenant will commit further similar breaches. Analysis and decision

I am satisfied that the rent was at least 21 days in arrears at the time the application was filed.

The tenant states that they are employed and receive assistance to pay their rent. Unfortunately, there was an issue with the tenant’s employment which temporarily effected their income. This has now been addressed.

A conditional order is appropriate. The tenant has demonstrated that they can meet their rent obligations and make payments towards the arrears. I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) of the Act. Name suppression

Section 95A of the Act provides that on the application of a party that has been wholly or substantially successful in proceedings, the Tribunal must order that their name or identifying particulars of that party not be published, unless the Tribunal considers that it is in the public interest to publish the names of the parties, or is justified because of the parties’ conduct, or any other circumstances of the case.

Although the landlord has been wholly successful, they do not seek name suppression. The tenant has avoided immediate termination and, in my opinion, has therefore been substantially successful. I therefore order suppression of their name and the address of the property.
