Reasons
- Mr Magan, the owner, and Mr Wright and Ms MacColl, property managers managing the property, all attended the video conference hearing. The tenant did not join the hearing as per the instructions in the Notice of Hearing and so did not attend the hearing. As the tenant was served, the hearing proceeded in her absence.
- The landlord has applied for termination of the tenancy, notice to quit, rent arrears and refund of the filing fee.
- The tenancy was a fixed-term tenancy due to expire on 1 March 2026.
- The landlord sent a termination notice dated 4 February 2026 to the tenant by email and delivered to the property, confirming that the tenancy term would not be renewed past the expiry of the fixed term, and that the tenancy would terminate on 1 March 2026.
- Despite this, the landlord said the tenant has refused to leave the property. The landlord said there is a history with the tenant, where she has requested in the past to leave the tenancy early during the fixed term, which the landlord granted, but she then also refused to leave. The landlord indicated there have been mental health issues with the tenant.
- The landlord provided a copy of the termination notice dated 4 February 2026 provided to the tenant.
- Given the evidence, I find the landlord provided notice to the tenant that the fixed term of the tenancy would not be renewed, nor would the tenancy be made into a periodic tenancy, but the landlord gave notice that the tenancy would terminate on 1 March 2026. This meets the requirements pursuant to sections 50(1)(a) and 60A(2) of the Residential Tenancies Act 1986.
- As the tenant has refused to leave beyond 1 March 2026, the landlord is entitled to possession.
- The tenancy ended on 1 March 2026, which is less than 90 days ago. The requirements of section 64(1) of the Residential Tenancies Act 1986 are satisfied.
- The tenancy is confirmed as terminated and immediate possession is granted to the landlord.
- I note that even if the tenancy had rolled over into a periodic tenancy, the rent arrears are well over 21 days in arrears and so the tenancy could have also been terminated on this ground.
How much rent is owing?
- The landlord provided rent records which prove the amount owing up to 5 April 2026, being $7,472.05. Given the termination of the tenancy and possession is granted to the landlord immediately, I deduct 3 days’ rent @ $67.14, for 3 April 2026 to 5 April 2026, for a sub-total of $201.42, thus reducing the rent arrears owing by the tenant to the landlord to $7,270.63 to 2 April 2026, which is the end of the tenancy and when the landlord is granted possession of the property. - Because Girish Magan has been successful with the claim I must reimburse the filing fee.
