Reasons
- The landlord attended the hearing.
- The tenants were given the option of appointing a representative if they could not attend the hearing. No one joined the hearing at the appointed time and the tenant in New Zealand did not answer the call I made to his phone. The tenants did provide written submissions and I have taken these into account.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The rent is 90 days in arrears. Had I not heard from the tenants I would have ended the tenancy at midnight tonight. Instead the tenancy will end on Sunday, which gives the tenants a few days to organise moving out.
- The tenants may file their own application because they have concerns about possible breaches by the landlord. This order does not prevent the tenants from filing an application.
- Because the landlord has wholly succeeded with the claim I must reimburse the filing fee.
