This application was scheduled to be heard by video conference. The tenants did not connect to the Teams link or ring in to the hearing as directed in the Notice of Hearing sent to them. Further, the calls I made to both numbers provided for them did not connect. The hearing therefore proceeded in their absence.

The landlord has applied for outstanding water rates, compensation, payment from the bond, and reimbursement of the filing fee following the end of the tenancy.

The tenancy ended on 2 February 2026. The landlord provided water rates invoices which prove the amount owing at the end of the tenancy – a total of $255.17.

Did the tenants comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The photographs show that the carpets were left significantly stained and dirty.

The cost of remedying this issue is proven with an invoice.

I am dismissing the claim for the cost of pest control because there was no evidence that the landlord attended the premises for this issue and no invoice to prove the cost.

Are the tenants responsible for the damage to the premises?

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.

The following damage was caused during the tenancy: (a) A cracked glass stove top; and (b) A bedroom carpet that was so damaged it needed replacement.

The damage is more than fair wear and tear, and the tenants have not disproved liability for the damage.

The amounts ordered are proved with invoices.

I have taken into account betterment and depreciation. The landlord should be returned to the position they would have been in had the tenants not breached their obligations, and should not be better or worse off. In calculating depreciation, I have taken into account the age and condition of the items at the start of the tenancy and their likely useful lifespan. Filing fee reimbursement

I am also ordering the tenants to reimburse the cost of filing this application to the landlord because the landlord was substantially successful with this claim against them. The bond

At today’s hearing the landlord advised that the bond of $2,080 was still at the Bond Centre and so I have ordered the money owed by the tenants to come from the bond, with the remaining bond money to be returned to the tenants. Methamphetamine contamination
