- The tenancy ended on 19 March 2026. The landlord provided rent records which show the amount owing at the end of the tenancy was $655.00.
- The tenant had a query regarding the calculation of rent arrears given that he began by paying one week rent in advance and also had to be a week in advance “at all times”. His query was that at the end of the rent cycle he would no longer be one week in advance if only one week’s rent had been paid in advance. The records of his first ten months of the tenancy are no longer available as they date back ten years and were held by a different property management company.
- Ms Tanner clarified the process and the confusion to Mr Southorn’s satisfaction.
- I also am satisfied that at the end of the tenancy the tenant owed $655.00 rent arrears.
- The tenant made an overpayment towards water rates of $30.00. The landlord has deducted this from the rent arrears.
- The claim is proved.
- Because Point Property And Portfolio Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
