Both parties attended the hearing.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

The applicant stated that the respondent left dogs in the property for approximately a two-week period. He provided a recording between himself and the SPCA which corroborates this, including the SPCA asking him, as the landlord, to cooperate and allow them to enter the property to remove dogs remaining inside. The SPCA officer confirms that they have removed an emaciated dog which had escaped through a second floor window.

The applicant stated and that there was excrement in the property, as well as strong dog odour. The applicant tells me that he was happy for dogs to stay in the property, but he has expectations that they would be kept responsibly.

The respondent attended the hearing and did not dispute the facts as stated by the landlord, except that he said that there was an opening in the fence that did not allow him to leave the dogs outside, and that the owner said to him that the carpets were old and therefore he could do what he wanted, including leaving the dogs inside the house.

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is not capable of remedy, the landlord is not expressly required to serve a 14-day breach notice on the tenant, however in this case the applicant did. A breach is not capable to remedy where the thing done, or its effect, cannot be undone.

However, unless the breach is serious, the Tribunal usually requires the landlord to have warned the tenant about the likely consequences of continued breach before it will exercise its discretion to terminate.

I am satisfied on the balance of probabilities that the tenant left dogs in the property causing extensive damage. The lack of judgement shown by the respondent in this action as well as disregard for the property satisfy me that the breach is not capable of remedy and as such It would be inequitable to refuse to terminate the tenancy.

The landlord provided rent records which prove the amount owing to the end of the tenancy. I am satisfied these records are correct.

The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Because [The applicant/s] has wholly succeeded with the claim I have reimbursed the filing fee and granted his request for suppression.
