[The landlord’s representative], representing the landlord, attended the video conference hearing. The tenant did not join the hearing as per the instructions in the Notice of Hearing, nor did he answer the phone when I tried to call him for the hearing. As the tenant was served, the hearing proceeded in his absence.
The landlord has applied for rent arrears and reimbursement of the filing fee.
The landlord said that the tenancy ended on 13 April 2025, when they became aware the tenant had left the property, without any notice to them. However, the landlord said they only wished to claim rent arrears up to 12 April 2026.
The landlord has provided rent records which prove the amount owing to 12 April 2026, which is $13,880.00.
The landlord explained that they issued 2 x 14-day notices to the tenant last year about rent arrears and then he started paying rent again, that they issued another 14-day notice to the tenant on 16 February 2026, that they called, emailed, texted, met and spoke with the tenant multiple times about his rent arrears, when the tenant would usually tell them he was expecting some money soon, would start paying some rent, and then rent would be missed again. The landlord said they had also experienced some health and family issues, during which time they were unable to pursue the tenant for rent arrears. The landlord said that, when they initially filed this application in March 2026, they had then claimed for termination of the tenancy, but had withdrawn that claim later when they discovered the tenant had left the property without notice to them. I am satisfied from the evidence that the landlord appears to have taken reasonable steps to try and mitigate their loss. Filing fee

The landlord requested name suppression and is entitled to this as they have been successful with the claim. Therefore, I order that the landlord’s name and identifying details and the tenancy address are not to be published. See section 95A(1) Residential Tenancies Act 1986.
