The landlord submitted an email sent by the tenant on 8 March 2026, advising of their intention to leave the premises due to an alleged burglary. On 9 March 2026, the tenant sent the landlord another email advising that the key was under the mat and wishing the landlord luck in finding a new tenant.

The landlord never agreed to ending the fixed term tenancy early. They offered to implement increased security measures such as, installing a gate and sensor lights at the premises. They also advised the tenant that the tenant needed to continue paying rent.

The landlord visited the premises in the afternoon on 9 March 2026 and submitted photographs from this visit. The premises are completely empty with no furniture or signs of anyone living in them. The landlord gave evidence that they visited the premises again on 12 March 2026 and it was in the same condition. The landlord also claims they have driven past the premises recently and noticed that the lawns are overgrown, and bins have not been taken out. No photographs from these more recent visits were submitted however, in the absence of any evidence to the contrary, I accept the landlord’s evidence.

The landlord submitted a rent summary, which proves the tenant has not paid rent since 2 March 2026. 1 Residential Tenancies Act 1986, section 61.

All of this evidence convinces me on the balance of probabilities that the tenant has left the premises without reasonable excuse and does not intend to return or to meet their obligations. For these reasons, I find the tenant has abandoned the premises.

The rent summary proves the rent is in arrears of $3,992.85 at the date of the hearing. Because the tenant has abandoned the premises and the rent is in arrears at the date of the hearing, the tenancy is terminated.

How much does the tenant owe in rent arrears?

A tenant who abandons a fixed term tenancy is liable to pay rent up to and including the date of the expiry of the term or the date a new tenancy begins, whichever occurs first. 2

The rent summary proves that rent arrears are $3,992.85 up to 21 April 2026. The bond of $1,300.00 has already been refunded to the landlord, which brings the total arrears down to $2,692.85.

The landlord’s claim for rent arrears is granted for $2,692.85 however, they may file another application for further rent arrears once a new tenancy begins or at the end of the fixed term if a new tenancy does not begin before then. Filing fee & name suppression

Because the landlord has been wholly successful with their claim, I must order the tenant to reimburse the filing fee. For the same reason, I must grant the landlord’s request for name suppression.
