The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenants want to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

The landlord provided a rent summary. The tenants had a chance after the last hearing to check the summary against their bank records. They agree the owe the money for rent.

At the hearing the landlord said $280 of the money paid by the tenants was in fact an amount for a plumber’s bill the tenants said they would pay. The tenants did not agree. The landlord did not have anything in writing recording an agreement that the tenants would be responsible for the bill. I find the $280 should be credited for rent.

Rent is at least 21 days in arrears. Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986 (RTA).

Mr Meredith said he wants time to apply for his KiwiSaver. The landlord agreed to this. I am satisfied the tenants will pay the debt within the period specified in the order and are unlikely to commit any further relevant breach. I have granted a conditional termination order.

The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) RTA. Other orders

Because the landlord has substantially succeeded with the claim I have reimbursed the filing fee.

The landlord has made an application for suppression. Section 95A RTA provides that the Tribunal may, on the application of any party to proceedings or on its own initiative, order that the name of a party not be published, having regard to the interests of the parties and to the public interest.
