This tenancy was for a fixed term from 8 January 2025 to 8 January 2026.

On Saturday 25 October 2025 the tenant advised the landlord in a Whatsapp message that he was leaving/had left the premises and clarified that he was going to another country “on Monday”. The landlord communicated with the tenant to try and obtain paperwork to enable the tenancy to be assigned.

The tenant did not engage any further with the landlord about the tenancy. The landlord swiftly readvertised the property but was not able to secure a new tenant until after the fixed period had ended.

The landlord’s claim is for unpaid rent until 8 January 2026 being the end of the fixed period.

Tenants cannot unilaterally terminate a fixed-term tenancy during its term (see section 50 Residential Tenancies Act 1986 (RTA) which sets out the circumstances in which a fixed term tenancy shall be terminated or will terminate prior to the expiry of the fixed period).

Here there was no agreement between the parties to end the tenancy any earlier than 8 January 2026. The landlord did not consent to the tenancy ending earlier. The tenant decided unilaterally that he would leave and no longer pay rent.

There are consequences for this. The RTA allows tenants to be held liable for rent until a replacement tenant is found or the fixed term ends, whichever occurs first.

I am satisfied that on the above facts the landlord is entitled to recover unpaid rent to the end of the fixed period.

A rent summary was provided. The sum claimed of $3,900 is proven. Power costs

I heard that the premises are a self-contained apartment in a larger premises.

The tenant was invoiced from time to time for his power by the landlord. There is a smart meter to establish power use by this tenant.

The landlord explained it receives a power bill for the whole house and then works out how much is owed by each of the occupants of the house. The landlord sought to recover costs based on actual use, plus a daily charge and also gave credit for free power periods. The power credit and the daily charge was split equally between the occupiers of the premises.

The tenant appears to now be overseas. The landlord decided that an order for the rent would be sufficient to meet its requirements as this would release the bond to it.

The landlord decided it would not pursue this part of the application, and it is therefore dismissed. Suppression and filing fee

The landlord has been substantially successful and so I award reimbursement of the filing fee.

The landlord seeks suppression of its identifying details. The Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case (see s 95A RTA).

The landlord has been substantially successful and there are no other relevant factors before me to refuse the request. Therefore, I award suppression of the landlord identifying details.
