On 24 February 2026, Mr Scheepers’ partner withdrew from the tenancy. Mr Scheepers continued as the sole tenant.

Mr Scheepers fell into rent arrears. The landlord filed this application on 12 March 2026. The application sought rent arrears, termination of the tenancy, compensation the cost of re-glazing the ranchslider and a call-out fee for Mr Scheepers locking himself out of the premises after-hours.

The hearing took place by video conference on 4 May 2026. [The landlord’s representative] represented the landlord at the hearing. Mr Scheepers did not join the link for the video hearing or phone through on the numbers set out in the notice of hearing. [The landlord’s representative] has not provided any information to the Tribunal or responded to the application in any way. I am satisfied that the application and the notice of hearing were served on [The landlord’s representative] in accordance with the requirements of the Residential Tenancies Act 1986 (“RTA”) and the hearing proceeded in [The landlord’s representative]’s absence. 1 Rent arrears

The rent was $360 per week. The landlord’s rent record shows that the regular payments of $360 stopped in early March. The landlord has only received one payment, of $100, since 4 March 2026.

The landlord’s rent record shows rent arrears of $2,985.71 to today’s date (4 May 2026).

The RTA provides that if there is more than one tenant on a tenancy, and one of the tenants withdraws from the tenancy, the rent that the continuing tenant(s) pay reduces for a period of two weeks from the date of the withdrawal. 2

This reduction was not factored into the landlord’s calculation of rent arrears.

Applying the formula for the reduction set out in the RTA 3 , the rent reduced by 50% for a two week period after 24 February 2026. The amount of rent arrears must be reduced by $360.00.

The proven rent arrears is $2,625.71. Termination

The application sought termination of the tenancy for breach. 4 1 Section 92 RTA 2 Section 56B(3)(d) & 56B(5) RTA 3 Section 56B(5) RTA

Because the rent is more than 21-days in arrears at the date of the hearing, the landlord is entitled to an order for immediate termination of the tenancy. 5 Re-glazing a call-out charge

In March 2026 the landlord discovered that a large glass pane in the ranchslider was smashed.

The cost of re-glazing was $719.60 per an invoice from [glass company].

Tenants are liable for damage beyond fair wear and tear that occurs during the tenancy. Tenants are liable for damage caused by themselves or by anyone who is at the premises with the tenant’s consent.

Tenants are not liable for damage that is caused by trespassers.

At the hearing [The landlord’s representative] comment that there was tension between Mr Scheepers and some of his neighbours.

I have no information about the circumstances in which the glass pane was smashed. The damage is beyond fair wear and tear, which means that Mr Scheepers is liable for the damage unless he can prove that the damage was not caused by himself or by anyone who was at the premises with his consent. 6 No such evidence was provided. Therefore, I find that Mr Scheepers is liable for the proven re-glazing cost.

The property has an after-hours service for security issues including lock-outs. Mr Scheepers used that service on 5 March 2026 when he locked himself out the premises. The invoice shows that Mr Scheepers contacted the service at

11pm.

Tenants are made aware of the cost of the service (in this instance a minimum 30-minute call out fee of $75 plus GST).

Mr Scheepers is liable for this cost. Filing fee, name suppression, bond

The landlord has been successful in this application, and I must also award the landlord the filing fee. 7
