Reasons

This application was scheduled to be heard by video conference. The tenant did not connect to the Teams link or ring in to the hearing as directed in the Notice of Hearing sent to him. The hearing therefore proceeded in his absence.
The landlord has applied for rent arrears, reimbursement of the filing fee and payment of the bond.

How much rent does the tenant owe?

The background to this claim is that the landlord gave the tenant a notice of termination of the tenancy which was due to expire on 29 May 2026. On 14 March 2026 the landlord was told by a neighbour that they thought the tenant had moved out.
When a tenant abandons the premises, the landlord is entitled to 3 weeks’ rent in lieu of notice, from the date that they knew, or ought to have known, that the tenant had left.
However, the landlord claims rent to 29 May 2026 – the termination date.
Section 49 of the Residential Tenancies Act 1986 provides that where any party to a tenancy agreement breaches any of the provisions of the agreement or the Act, the other party shall take all reasonable steps to limit the damage arising from that breach.
I am ordering the tenant to pay 3 weeks rent in lieu of notice from 28 March 2026. This is the date by which I consider that the landlord ought reasonably to have known, by going to the premises, whether the tenant had abandoned the premises – 2 weeks from when they were advised by the neighbour.
Three weeks from 28 March 2026 is 11 April 2026. The rent record shows that as at 11 April 2026 the tenant owed $4,504.28 in rent arrears. He is required to pay this amount. Filing fee reimbursement
