The hearing was conducted by way of video conference.
[The landlord’s representative] appeared on behalf of the landlord.
Mr Paul did not appear. Nor did he contact the Tribunal registry to explain his absence or seek an adjournment.
I attempted to contact Mr Paul using the cell phone number ending [redacted] provided on the application. The call was answered by a female who stated that she did not know who Mr Paul was.
[The landlord’s representative] advised me that he had previously used this same number to contact Mr Paul without issue during the first month of the tenancy.
[The landlord’s representative] further advised that he had met Mr Paul in Raglan prior to the hearing. [The landlord’s representative] stated that Mr Paul was aware of the scheduled hearing and said: “When I saw Mr Paul in Raglan, he told me ‘just let the Tribunal make the decision.’”
I accept [The landlord’s representative]’s evidence that Mr Paul was aware of the hearing and chose not to attend.
In the absence of the tenant, I proceed to determine the matter on the evidence before me.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
