- Shania Marie Heslip owes Rent Wise Property Management Limited $616.57 (“the debt”) calculated below:
- Shania Marie Heslip must pay rent and the debt as follows: a. by a payment of 645.00 for weekly rent on 10 April 2026; b. by 7 weekly payments of $725.00, being $645.00 for rent and $80.00 for the debt, starting Friday 17 April 2026 and continuing every Friday after that to and including Friday 29 May 2026; c. by a final payment of $701.57, being $645.00 for rent and $56.57 for the debt, on Friday 5 June 2026.
- Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
- If the tenant fails to pay rent and rent arrears as required by Order 2, within 2 working days of the due dates or if, within 3 months from the date of this Order the tenant fails to pay the weekly rent by 2 working days after the due date: a. the tenancy at 36 Chelsea Street, Linwood, Christchurch 8062 will terminate and the landlord will have immediate possession of the premises; b. the balance of the debt will be payable immediately.
- If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
Reasons
- The landlord attended the hearing which was scheduled by teleconference. The tenant did not attend. Two calls were made to the number given for the tenant in the Notice of Hearing, which was properly served. Neither call was answered.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. 1
- The landlord’s rent records show that at 15 March 2026 when the application was filed, the rent was 21.64 days in arrears.
- Soon after that, the tenant brought the rent up to date, although arrears have arisen again by the date of this hearing, as noted in the above Order.
- Rent payments throughout the tenancy have been very erratic.
- The landlord is entitled to have the arrears paid within a reasonable period. The landlord is also entitled to have the weekly rent paid on the due date, without having to constantly follow up on unpaid rent.
- Given the efforts made by the tenant to bring the rent up to date, the tenant should have a final opportunity to clear the arrears and demonstrate that the rent can be paid on time consistently.
- If either of those things don’t happen, the tenancy should end. 1 S. 55(1)(a) and (1A) RTA
- On that basis I have granted a conditional termination Order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. 2
- Because Rent Wise Property Management Limited has succeeded with the claim I must reimburse the filing fee.
