Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 14 March 2026 the landlord became aware that the tenant had abandoned the premises. The tenants had paid a large sum of rent in advance but on 4 March 2026, the tenants’ rent went into arrears. The landlord tried to contact the tenant and on 9 March 2026 issued a rent arrears notice.

Having heard nothing from the tenant, on 11 March 2026, the landlord gave the tenant notice of an inspection which was conducted on 14 March. The landlord produced photographs which show that the notices that had been placed under the door remained there. There were dirty dishes in the sink. There were no clothes in the wardrobes and drawers. I am satisfied that the premises were abandoned.

Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately, that is 3.55pm today.

The landlord provided rent records which prove the amount owing up to 7 April 2026 is $3,110. That amount is ordered.

Because this was a fixed term tenancy due to end on 26 May, the landlord may be entitled to further arrears. He will advertise the property and may apply to the Tribunal for arrears up until the date he relets the property or the end of this tenancy, whichever is the sooner.

The landlord had not included an application for refund of the bond and so I cannot order that the bond is paid to the landlord, but there may be a further application for that.

The landlord may also have other claims such as cleaning costs at the end of the tenancy.
