Reasons

A representative of the landlord attended the hearing by video.

The tenant did not attend the hearing by the video link or dial-in instructions provided in the Notice of Hearing.

The Tribunal file shows that the application and instructions for attending the hearing were sent to the tenant by email. The tenant also submitted documents in relation to the application. I am satisfied that the tenant was given a reasonable opportunity to attend the hearing and that it was appropriate to proceed in her absence.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.

Rent was at least 21 days in arrears on the date the application was filed, so I must terminate the tenancy. See section 55(1)(a) Residential Tenancies Act 1986.

The tenant provided extensive submissions and evidence before the hearing. A lot of the information related to a previous application by the tenant, which has already been determined by the Tribunal. I cannot reconsider matters which have already been determined.

To the extent that the tenant’s documents raised new matters, she had not made a cross-application to the current application for termination and rent arrears. On my instructions, Registry contacted both parties before the hearing, to confirm that the only matter I could consider today, was the landlord application for termination and rent arrears.

Rent has not been paid since 25 February 2026. The tenant’s submission acknowledged that rent is owed, but said that arrears have arisen because of failures by ACC. Even if that is correct, the tenant remains responsible for paying her rent. The RTA provides that, if rent is 21 days in arrears at the date of an application, the Tribunal shall terminate the tenancy.

I have allowed the tenant a short period of time to make alternative arrangements. The tenancy will end and the landlord will be entitled to possession of the premises at 11:59pm on Saturday, 2 May 2026.

The landlord provided rent records which prove the amount owing at the end of the tenancy.

As the landlord was the successful party, I have awarded reimbursement of the Tribunal application fee and granted its request for suppression of its details.
