The Tenant did not attend the hearing, so has provided no explanation for the unpaid rent. The rent arrears

The Landlord has provided a rent summary and a bank account statement to demonstrate the unpaid rent. I accept that rent summary and bank account statement as an accurate record of the rent payments during the tenancy.

That evidence shows that, as at the date of the hearing, the Tenant owed rent arrears of $2,100. The Landlord says that the unpaid rent is $2,700, which includes rent up to 10 April. I cannot not include any rent owing beyond the date of the hearing in the calculation of rent arrears. That is because rent payable under a tenancy agreement accrues from day to day, and upon termination of a tenancy, the rent must be apportioned on a day to day basis only. 1 Termination and possession

The Landlord is entitled to terminate the tenancy and obtain possession on two grounds.

First, where a landlord has issued a 14-day notice due to unpaid rent and then applied to the Tribunal to terminate the tenancy, as has occurred here, the Tribunal may terminate the tenancy where the rent at the date of the hearing is in arrears by at least 21 days. 2

As at the date of the hearing, the rent was in arrears by 21 days. Accordingly, applying section 56(2) and 55(1)(a) of the Residential Tenancies Act, I must terminate the tenancy and grant possession to the Landlord.

Second, the Tribunal must also make an order terminating a tenancy where: 3 (a)On 3 separate occasions within a 90-day period an amount of rent is owing for at least 5 working days; and (b)on each occasion the landlord gave the required written notice; 4 and (c)each notice stated how many other notices the landlord had given in relation to the same tenancy and 90-day period; and (d)the landlord applied to the Tribunal within 28 days after the landlord gave the third notice.

In this case, the rent was unpaid on three separate occasions within a 90-day period starting 24 February 2026, and on each occasion the Landlord gave the required notice containing all the required information. The Landlord then applied to the Tribunal within 28 days of the third notice. I see no basis for making this order conditional. 5 I have no reasonable grounds for believing that the Tenant will pay the rent arrears or continue to pay rent in the future.

I therefore order that the tenancy is terminated, and possession of the premises is granted to the Landlord. Filing fee and suppression

The Landlord has been wholly successful in his claim. He is entitled to name suppression and to recover the filing fee of $28. Bond

I direct the Bond Centre to release $2,128 of the bond to the Landlord.
