Reasons
- Both parties attended the hearing. Ms Redman had her friend present who also gave evidence.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- Whilst the applicant raised other issues for termination, including stating that a ninety day notice was issued on 24 March 2025, this did not form part of the application. However, the grounds form termination under section 55(1)(a) have been established in that rent that was paid at $90 per week was in arrears by 21 days at the time of filing this application.
- The law therefore states that termination is to take effect. The applicant however agreed to terminate the tenancy on Sunday the 14 th June, giving he tenant another three days. The arrears were calculated to that time.
- Because Visionwest Community Trust has wholly succeeded with the claim I must reimburse the filing fee.
