I am satisfied Jessie Emma Mearns-Blakey had received proper notice of the hearing time, date and place and chose not to attend.

Should the tenancy be terminated?

Rent was at least 21 days in arrears on the date the application was filed and was still in significant arrears on 30 June 2026. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing at the end of the tenancy. When did Jordan Teijah Shakariah Blank’s tenancy end?

On 2 February 2026, Ms Blank moved out of the tenancy and notified her co- tenant that she was doing so because she was being subject to family violence and it was seriously affecting her physical and mental health.

Ms Blank has provided evidence that she moved into a woman refuge facility on 10 February 2026 to assist her to recover from the effects of family violence. She still resides in this facility currently and is slowly finding her way again after being in a family violence situation in this tenancy. She has provided proof of this family violence to the Tribunal in confidence.

On 5 March 2026, Ms Blank gave written notice to the landlord by email that she was ending her tenancy under the s56B family violence provisions of the RTA. This meant that Ms Blank’s tenancy was ended with 2 days’ notice. The landlord never wrote back asking Ms Blank for any additional information about the family violence situation. Therefore, Ms Bank acted under the reasonable belief the landlord had accepted her two days’ notice and her tenancy ended on 6 March 2026.

At the hearing today, the landlord accepted it had not followed up Ms Blank’s termination notice and that it would be inequitable for it to now resile from its tacit acceptance of her family violence related tenancy termination. It therefore accepted that her tenancy ended on 6 March 2026 and that she would be held liable for the rent arrears accrued to that date and nothing further.

Ms Blank agreed to pay the $326.21 rent arrears accrued to 6 March 2026 on the condition her tenancy is taken as ended on that date and the landlord will not pursue her for any further debts related to this tenancy or the ending thereof, including any vacated damage claims it may wish to make after regaining possession of the premise. Reimbursement of filing fee

Section 102(4) of the RTA confirms that applicants that are wholly or substantially successful in proving their claims will have their filing fee reimbursed.

Because Earth Connections Limited has substantially succeeded with the claim I have reimbursed the filing fee.
